This is an agreement between you, Niftiee, and the purchased brand product. After purchasing a product, you agree to be bound by the terms of this agreement. If you do not accept the terms of this agreement, then you may not use Niftiee’s services and may return your product in accordance with any applicable return policy.

1. Terms; Acceptance

Welcome to Niftiee. These Terms of Use (Terms) are offered to you by Niftiee and its affiliates that govern your use as a visitor to https://niftiee.com/ and/or other websites managed by Niftiee that reference the Terms (Niftiee). Please read these Terms carefully. By using, accessing and/or visiting the Niftiee website, you accept and agree to these Terms. If you do not accept and agree to the Terms, you should immediately stop using, accessing, and/or visiting the Niftiee website.

Please also carefully read through Niftiee’s Privacy Policy, located below. By agreeing to these Terms, you also agree to and accept our Privacy Policy.

In addition to the Terms and Privacy Policy, other and/or additional terms may apply in certain limited instances such as signing up for a promotion or opt-in to receive an email. Niftiee will present such terms to you before you opt-in or purchase a product.

We reserve the right to make changes at any time to the Niftiee sites, these Terms, policies and warranty information are applicable to a service, purchase or opt-in. We will notify you of any material changes to the Terms by posting the new Terms on the Niftiee website. We advise to consult these terms regularly for any changes. The date of the last revision appears at the top of the Terms. Your use of the Niftiee sites following any changes to the Terms will signify your acceptance of the revised terms.

Subject to these Terms, Niftiee grants you limited licence to access and use of the website for your personal, non-commercial use. However, except as otherwise provided in these Terms, the contents of the Niftiee Website are owned by or licenced to Niftiee and its suppliers and is protected by law. Consequently, without our written consent, you may not download (other than through page caching) or modify a Niftiee site or any portion thereof, or reproduce, distribute, duplicate, copy, display, sell, mirror, or otherwise exploit the Niftiee website or any portion thereof. You are granted a limited, revocable, and non-exclusive right to create a hyperlink to the home page of https://niftiee.com/ so long as the link does not portray Niftiee in a false, misleading, derogatory, or otherwise offensive matter. You may not use any meta-tags or any other “hidden text” utilizing Niftiee or trademarks to reference to any Niftiee Website. You may not use disguised referrals to link to any Niftiee sites. Without our prior written consent, you may not exploit the Niftiee websites or any content appearing therein for commercial purposes. If you are under age 13, you may use the Niftiee sites only with the involvement of a parent or guardian. Any unauthorized use of the Niftiee website or use in violation of these Terms terminates this licence agreement.

4. Subscription

A subscription agreement is shared between yourself and Niftiee, it is a recurring payment which activates your membership with us. You need to subscribe to be able to access/use Niftiee. By subscribing you are automatically agreeing to these terms and conditions. NOTE: We do not send out upcoming payment emails, unless asked otherwise. If you are interested in opting into the yearly reminder emails, please get in contact with us via email (support@niftiee.com).

However, we do not warrant that any product and/or support descriptions or other content on the Niftiee website is accurate, complete, or error-free. If you purchase a Niftiee membership either through the https://niftiee.com/  you believe it is not as described, your sole remedy is to get in contact with us via email admin@niftiee.com

1. Termination

Niftiee may terminate your rights under this agreement if you fail to comply to any of its terms. In case of such termination, Niftiee may immediately revoke your access to its products in accordance with this provision and any additional terms and conditions applicable to the Niftiee terms. Failure to insist upon or enforce your strict compliance with this agreement will not constitute a waiver of any of its rights.

Any dispute or claim arising from or relating to these Niftiee Services Terms of Use is subject to the Applicable Law and Our Liability sections in these Terms. References in those sections to the Conditions of Use or “these conditions” shall, for the purposes of these Niftiee Services Terms only, be interpreted as referring to these Niftiee Terms. Nothing in these Niftiee Services Terms or excludes our responsibility to you where it would be unlawful to do so. This includes responsibility for fraudulent representations made by us, for death or personal injury caused by our negligence, or for breach of your legal rights.

You hereby agree this by using Niftiee services for its intended purpose and to not make any reproductions, modifications, or alterations to the content in anyway whatsoever.

Niftiee, the logo, the names of the suppliers’ products and other graphics, logos, page headers, button icons, scripts, and service names may be trademarks, registered trademarks, or trade dress of Niftiee and its suppliers. You may not use the foregoing in any manner that disparages or discredits Niftiee or their suppliers, or it is likely to cause confusion among customers. You may not use Niftiee’s trademarks and/or trade dress in connection with any product or service without our express written consent.

8. Limitation of Liability

IN NO EVENT SHALL NIFTIEE, THEIR EMPLOYEES, OR SUPPLIERS BE LIABLE FOR ANY SPECIAL, INCIDENTAL, INDIRECT, WHATSOEVER, INCLUDING THOSE RESULTING FROM LOSS OF USE, DATA OR PROFITS, HOWEVER CAUSED AND REGARDLESS OF THE THEORY OF LIABILITY, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF OR ACCESS TO OR INABILITY TO ACCESS OR USE THE NIFTIEE SITES (INCLUDING THE SERVICES AND SUPPORT SERVICES OFFERED ON NIFTIEE SITES), EVEN IF NIFTIEE HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. IN NO EVENT WILL NIFTIEE’S LIABILITY EXCEED THE AMOUNT PAID BY YOU FOR A SERVICE. The foregoing limitations will apply even if any warranty or remedy provided under this Agreement fails of its essential purpose. Some jurisdictions do not allow the exclusion or limitation of incidental or consequential damages or other limitations set forth above, so the above limitations or exclusions may not apply to you.
